This Act is a type of constitutional law, with the adoption of bodies such as the Ministry of Welfare and Social Security and the Supreme Council of Welfare and Social Security. But the law faced with major challenges in its implementation. This article focuses on analysis of the nature of the conflict in the process of drafting this law, and the main question is what the factors are causing the conflict for different actors around different parts of the law and what strategies have these actors selected to deal with it. Based on the Critical Interpretive Methodology approach, the research data were collected through interviews with key stakeholders in designing the Comprehensive System and reviewing the negotiations of the Islamic Consultative Assembly at the time of adoption of the bill and were analyzed by content analysis technique. According to the findings of the study, structural and interest conflicts have a great overlap with the most impact on the design process of the system structure. بحث طراحی ساختار نظام جامع رفاه و تأمین اجتماعی، نخستین‌بار در سال 1377 مطرح شد؛ اما فرایند نهایی ‌شدن آن، حدود شش سال به‌طول انجامید. قانون ساختار از نوع قوانین تأسیسی است و با تصویب آن، ارکانی نظیر وزارت رفاه و تأمین اجتماعی و شورای عالی رفاه و تأمین اجتماعی تأسیس شدند و تغییراتی در سازمان‌دهی حوزۀ رفاه و تأمین اجتماعی رخ داد؛ اما این قانون، در اجرا با چالش‌هایی اساسی مواجه شد و به‌تدریج، ابتدا براساس مصوبه‌ای در سال 1386 حوزۀ امدادی منفک شد، سپس وزارت رفاه و تأمین اجتماعی در دو وزارتخانۀ کار و امور اجتماعی و تعاون ادغام و شورای عالی رفاه و تأمین اجتماعی نیز منفعل شد. در این مقاله، بر تحلیل ماهیت تعارض در فرایند تدوین این قانون تمرکز شده و پرسش اصلی این است که «عامل‌های مولد تعارض برای بازیگران مختلف چه عامل‌هایی بوده و این بازیگران چه راهبرد‌هایی را برای مواجهه با آن برگزیده‌اند؟». براساس رویکرد روش‌شناسی تفسیریِ ‌انتقادی، داده‌های پژوهش از راه مصاحبه با دست‌اندرکاران اصلی طراحی نظام جامع و مطالعة مذاکرات مجلس شورای اسلامی در زمان تصویب لایحه گردآوری و تحلیل شده است. براساس یافته‌های پژوهش، تعارض‌های ساختاری و منفعتی هم‌پوشانی زیادی با هم داشته و به‌همراه تعارض پارادایمی، بیشترین تأثیر را بر فرایند طراحی ساختار نظام جامع داشته‌اند. https://jisr.ut.ac.ir/article_73412_0f271f7f565c6529ab5365c73ddd1357.pdf
